1. Introduction
Ophelia Health, Inc. (“Ophelia Health,” or “we,” “our,” or “us”) respects your privacy.
This policy is for anyone (“you”, “your”) who chooses to: use our digital products such as websites or web applications hosted on the domain “ophelia.com” (our “Website”), interact with us, do business with us, call us, text us, seek medical support through us, request information from us, provide information to us, or broadly interact with Ophelia Health in any manner (“Interact(ing) With Us”).
This Privacy Policy (our “Privacy Policy” or “this policy”) describes the types of Personal Information about you that we may collect or that you may provide when Interacting With Us, how we collect that Personal Information and our purposes for collecting it, and our practices for using, maintaining, protecting, and disclosing that Personal Information. Personal Information means information relating to an identified or identifiable individual, as further defined below.
This policy applies to Personal Information we collect:

- in email, text, and other electronic messages between you and us; and
- when you talk to us by tele/video-chat or by telephone.
It does not apply to Personal Information collected by:
- any other website, including any other website operated by Ophelia Health or any third party;

Note, Ophelia Health is not a medical group. Any telemedicine consults obtained through our Website are provided by independent medical practitioners including, but not limited to, Ophelia Medical Group FL, P.A. and all members of its affiliated covered entity (“Ophelia Medical”), an independent medical group with a network of United States based health care providers (each, a “Provider”). Ophelia Medical (or your own medical provider if you do not use an Ophelia Medical Provider) is responsible for providing you with a HIPAA Notice of Privacy Practices describing its collection, use, and disclosure of your protected health information under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). This Privacy Policy does not apply to the collection, use, and disclosure of your protected health information.
Ophelia Health is the controller of the Personal Information we hold about you in connection with your use of the Website. This means that we determine and are responsible for how your Personal Information is used.
2. Children Under the Age of 18
Our Website is not directed to, and we do not intend to, or knowingly, collect or solicit Personal Information from children under the age of 18. If an individual is under the age of 18, they should not use our Website or otherwise provide us with any Personal Information either directly or by other means. If a child under the age of 18 has provided Personal Information to us, we encourage the child’s parent or guardian to contact us to request that we remove the Personal Information from our systems. If we learn that any Personal Information we collect has been provided by a child under the age of 18, we will promptly delete that Personal Information.

We collect several types of Personal Information from and about you when you Interact With Us. The Personal Information we collect may include:
- Personal information that directly identifies you, such as: name, email address, street address, telephone numbers, insurance information, date of birth, credit or debit card number (for payment purposes only), images and video of you, records and copies of your correspondence if you contact us, race or ethnicity, criminal history, your medical history, and health information; and
- Internet or other electronic network activity information, such as: IP address, device ID, browser type, traffic data, logs, referring/exit pages, date and time of your interactions with us, error information, clickstream data, your Internet connection, the equipment you use to access our Website and usage details, details of transactions you carry out through our Website and of the fulfillment of your services, and other communication data and the resources that you access and use on the Website.
4. How We Collect Personal Information About You
We collect Personal Information:
- directly from you when you provide it to us, such as filling in forms on our Website, sending us emails, using our Provider consultation services, purchasing products, or requesting further services;
- automatically when you are Interacting With Us; and
- from the following third parties:
- Social Media: When an individual Interacts with Us through various social media networks, such as when someone “Likes” us on Facebook or follows us, comments, or shares our content on Facebook, Instagram, TikTok, YouTube, LinkedIn or other social networks, we may receive some information about individuals that they permit the social network to share with third parties. The data we receive is dependent upon an individual’s privacy settings with the social network and may include certain profile information. We use this information to operate, maintain, and provide to you the features and functionality of the Website, as well as to communicate directly with you, such as to send you email messages about products and services that may be of interest to you.

All of the information collected automatically through these tools allows us to improve your customer experience. For example, we may use this information to enhance and personalize your user experience, to monitor and improve our Website and Website and the services, and to improve the effectiveness of our Website and the services, offers, advertising, communications and customer service. The services provided by these organizations include providing IT and infrastructure support services, and order fulfillment, marketing, and payment processing services, and professional services such as services provided by auditors, law firms, and accounting firms. 7. Third Party Data Collection and Online Advertising
We may participate in interest-based advertising and use third party advertising companies to serve you targeted advertisements based on your browsing history. We permit third party online advertising networks, social media companies and other third-party services, to collect information about your use of our online services over time so that they may play or display ads on our Services, on other websites or services you may use, and on other devices you may use. Typically, though not always, the information used for interest-based advertising is collected through tracking technologies, such as cookies, web beacons, embedded scripts, location-identifying technologies, and similar technology, which recognize the device you are using and collect information, including click stream information, browser type, time and date you visited the Sites, AdID, general geolocation and other information. We may share a common account identifier (such as a hashed email address or user ID) with our third-party advertising partners to help identify you across devices. We and our third-party partners use this information to make the advertisements you see online more relevant to your interests, as well as to provide advertising-related services such as reporting, attribution, analytics and market research. We may also use services provided by third parties (such as social media platforms) to serve targeted ads to you and others on such platforms. We may do this by providing a hashed version of your email address or other information to the platform provider.
We may engage in the following:
- Social Media Platforms. We may display targeted advertising to you through social media platforms, such as Facebook, Instagram, LinkedIn, and other social media forums. These companies have interest-based advertising programs that allow us to direct advertisements to users who have shown interest in our services while those users are on the social media platform, or to groups of other users who share similar traits, such as likely commercial interests and demographics. We may share a unique identifier, such as a user ID or hashed email address, with these platform providers or they may collect information from our website visitors through a first-party pixel, in order to direct targeted advertising to you or to a custom audience on the social media platform. These advertisements are governed by the privacy policies of those social media companies that provide them. If you do not want to receive targeted ads on your social networks, you may be able to adjust your advertising preferences through your settings on those networks.
- Third Party Partners. We work with a variety of third-party partners to provide advertising services. For example, we use Google Analytics to recognize you and link the devices you use when you visit our Services on your browser or mobile device, log in to your account on our Services, or otherwise engage with us. We share a unique identifier, like a user ID or hashed email address, with Google to facilitate the service. Google Analytics allows us to better understand how our users interact with our Services and to tailor our advertisements and content to you. We may also utilize certain forms of display advertising and other advanced features through Google Analytics. These features enable us to use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as Google Ads, Google Display Network and YouTube Ads advertising cookies) or other third-party cookies together to inform, optimize, and display ads based on your past visits to the Services. Please note that when you opt out of receiving interest-based advertisements, this does not mean you will no longer see advertisements from us or on our online services. It means that the online ads that you do see from DAA program participants should not be based on your interests. We are not responsible for the effectiveness of, or compliance with, any third-parties’ opt-out options or programs or the accuracy of their statements regarding their programs. In addition, third parties may still use cookies to collect information about your use of our online services, including for analytics and fraud prevention as well as any other purpose permitted under the DAA’s Principles.
8. Your Rights and Choices Regarding Your Personal Information and Accessing and Correcting Your Personal Information
- Modifying Your Information: You can review and change your Personal Information by logging into your Account Information page. You may also notify us through the Contact Information below of any changes or errors in any Personal Information we have about you to ensure that it is complete, accurate, and as current as possible or to delete your account.
- Deleting Your Information: We cannot delete your Personal Information except by also deleting your account with us and thus no longer provide you service. We may also not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect. Once your Personal Information has been deleted, if you start Interacting With Us again, we will begin to collect new Personal Information conforming to this policy.
- Email Communications Preferences: You can stop receiving promotional email communications from us by clicking on the “unsubscribe” link provided in such communications. You may not opt-out of service-related communications (e.g., account verification, transactional communications, changes/updates to features of the Website and the services, technical and security notices).
9. Changes to Our Privacy Policy
We may change this Privacy Policy at any time. It is our policy to post any changes we make to our Privacy Policy on this page with a notice that the Privacy Policy has been updated on the Website’s home page. If we make material changes to how we treat our users’ Personal Information, we will notify you by email to the email address specified in your account or through a notice on the Website’s home page.
